Privacy Policy

The Personal Data Protection Act 2010 (“Act” or “PDPA”) was introduced by the Government of Malaysia to regulate the processing of personal data in commercial transactions. The Act, which applies to all companies and firms that are established in Malaysia, requires us to inform you of your rights in respect of your personal data that is being processed or that is to be collected and further processed by us when using the PropLive mobile application (“the Application”) as well as related applications including Website and Software Login (collectively, “PropLive”). The Act also requires us to obtain your consent for any processing of your personal data.

The terms and conditions herein this Agreement govern your use of any electronic and information services made available, rendered and/or provided by ACCVEN SDN. BHD. (Company Registration No.: 1335523-V), a Malaysian-incorporated company located at 85C, Jalan SS 21/60, Damansara Utama, 47400 Petaling Jaya, Selangor Darul Ehsan, Malaysia (“We” or “Our” or “Us”), a Malaysian-incorporated company, either itself or through its subsidiaries or affiliates or related companies or licensees, via the Application in accordance with the Act.

By using PropLive, you are indicating that you have read and understand the terms and conditions herein. Notwithstanding any additions to the Act or requirements of time, we may amend this Agreement at any time without prior notice to you and whenever possible, notify you of any such amendment via email or the Application.

 

1. Your personal data

1.1.    Types of personal data

Personal data means any information which relates to you and which was collected or provided to PropLive for the purposes stated in Clause 2 below. The personal data that we collect includes, but is not limited to the following:

  1. Name,
  2. Identity card number or passport number (non-citizen),
  3. Correspondence address and country,
  4. Telephone and mobile number,
  5. Email address,
  6. Your preferences for a particular type of property or service, and
  7. Occupation or job title.

 

1.2.    Source of personal data

PropLive collects your personal data directly and indirectly from you from the use of the Application and from any contact person(s) or our vendor(s)’ contact published herein the said Application. For example:

  • when you contact our professionals or customer service team or any member of our Company directly through the Application, or our website; for example, upon enquiry of our products and/or services,
  • through marketing materials such as digital advertisements and leaflets, marketing activities or events, for example exhibitions and/or business card collections via fish-bowl method,
  • through third parties’ websites or in-person, namely our clients such as our approved vendor(s), advertiser(s), business partner(s) and/or property agent(s), and
  • through regulatory authorities.

 

1.3.    Obligatory personal data

All information requested from you is obligatory to be provided by you unless stated otherwise. Should you fail to provide the obligatory information, we would be unable to provide you with the relevant product or service desired or requested for and therefore we would be unable to process the relevant commercial transaction.

2. Purposes for collecting and further processing (including disclosing) your personal data

Your personal data is collected and further processed by PropLive as required or permitted by law and to give effect to your requested commercial transaction, including the following:

  • Making appointment to view a property, making a requested payment online or offline or physically and ultimately purchasing and renting a property,
  • Contacting us for an enquiry or complaint,
  • Participating in marketing and promotion activities,
  • Registering your details with us on the Application, or our website,
  • To process your order to purchase our products and/or services,
  • To provide you with the services or information requested for,
  • To contact you regarding product information, services, events, promotions, advertising, various types of marketing and commercial materials which we feel may interest you,
  • To provide you with after-sales services,
  • For our internal record management,
  • To carry out market analysis, market research, product targeting and segmentation, and customer profiling to gauge market trends,
  • To provide you with additional customer support,
  • To ensure that all our content herein the Application, or our website, is presented in the most effective manner for you and for your viewing devices,
  • To survey and ultimately to improve the quality, the ‘star-rating’ in download platforms and the responsiveness of our Application’s products and/or services,
  • To provide direct or ad-hoc assistance on your financing application in relation to your purchase or rent,
  • To operate our premises in a manner which is in the conduct of a typical business nature, physically secure and befitting of health and safety requirements, and
  • For our internal investigation, for required regulatory and fraud investigation or audit and for any circumstances deemed for security purposes.

Accuracy and retention of personal data

3.1.    We have good internal procedures in place to maintain PDPA compliance at a reasonable level or accuracy, completeness and relevancy for the purposes for which your personal data was collected.

 

3.2.    Your personal data collected will be retained by us for the duration permitted and required under Malaysian laws, which may extend to periods after the deactivation of the Application or your defunct usage of the Application and/or the termination of your contractual relationship with us.

 

3.3.    You may opt-out from receiving any marketing or promotional material at any time via PropLive’s settings menu. You may select ‘Unsubscribe our Newsletter’ option provided below in every of our email marketing blasting or auto-generated Mailchimp services or you may contact us at our contact details provided in the Application.

4. Accuracy and retention of personal data

4.1.    We maintain adequate security central system to safeguard the confidentiality and security of your personal data.

4.2.    Your personal data provided to us may be disclosed to the following classes of third parties (in or outside Malaysia) as required under the law or pursuant to relevant contractual relationship (for example, where we appoint third-party service providers) or for the purposes or directly related to the purposes stated in Section (2) above:

  • Entities within our Company including related companies, subsidiaries, holding companies, associated companies and outsourcing partners,
  • Our business partners such as insurance companies, banks, financial institutions, credit-checking companies and credit agencies, legal partnerships, and advertisers,
  • Third-party appointed by us to provide a wide range of services to us in the course of our business or on our behalf such as auditor, lawyer, company secretary, office-related service providers, printing company, telecommunications company, contractor, events and training organisers and other services appointees, and
  • Law enforcement agencies, government departments, regulatory bodies, courts, tribunals, and/or other authorities as required by law.

 

5. Processing of personal data in the application and its related features

5.1.    Links and APIs to other software interface or websites

Third-party links and APIs to other software interface or websites may be provided on the Application for your convenience and information. These sites may have their own privacy statement and we do not control, do not recommend or endorse these sites and therefore, we shall not be held responsible for any harm or damages arising from the use of these sites or their contents. We encourage you to read the privacy policies of these sites.

 

5.2.    Location-enabled products or features

Location-enabled products or features transmit your GPS location information to us. We will not use the information sent to us or provided by you to us for any other purposes other than to provide the services you requested for. All location-enabled functions are opted-in by you and you have control over your participation and can turn these services off at any time within your mobile phone.

 

5.3.        Analytical functions

We will utilise Google Analytics, or other similar statistical and analytical tools, to help the Application better serve you through improved products and services made available in the Application in the future. Any information collected herein will not allow us to identify you. It may, however, let us know anonymously, the products and services most searched by you within the Application as well as the device type used, operating system used and your country of origin.

 

5.4.        Profile settings and registration forms

The Application requires you to provide a limited amount of personal information to obtain the products and services you requested. You shall set up a personalised user account with us containing your name, email, address, contact number and other preferences. There will also be registration forms (could be of varying formats) within the Application requiring your personal data, not limited to the above, which is used as an indication of your keen interest into the selected products and services. These personal data will only be used for its intended purpose, i.e. to respond to your message or deliver the requested products and services.

 

5.5.        Website cookies

This is applicable for our website only. In processing your information, cookies, which is a text file placed into the memory of your computer, may be used. We are capable to use these cookies to identify you. We may be able to collect the following information during your visit to our website and/or the fully qualified domain name from which you accessed our site, or alternatively, through your internet protocol (IP) address:

  • The date and time in which you accessed our website,
  • The URL of any webpage from which you accessed our website, and
  • The web browser which you are using and the pages which you have accessed.

 

6. Right to access and correct personal data

By providing to us your personal data, you hereby consent to the processing of your personal data in accordance with all the potential risk of foregoing. You are fully responsible for reviewing and becoming familiar with all terms and conditions herein stated, or any alterations or modifications to the terms and conditions herein this Agreement at any point of time. You may at any time hereafter make written inquiries and submit a request to us to limit the processing of your personal data.
